Kurapia, Inc. – Agreement for Purchase
Version 2.0. Effective August 18, 2026.
Please read before completing your order. By selecting “I Accept Terms” at checkout, you agree to the terms below and enter into a binding agreement with Kurapia, Inc.
1. Live plant material
You are purchasing living nursery stock. Live plants are perishable, cannot be returned, and are not eligible for return or exchange once shipped. Your remedies are limited to the claim process in Section 3.
2. Delivery, inspection, and weather holds
Title and risk of loss pass on delivery by the carrier. Please arrange for someone to receive the shipment on the delivery date and to open the cartons promptly. Plants left unopened in cartons will decline.
If weather at your location is a concern, notify us at info@kurapia.com by 10:00 AM Friday of the week before your shipment and we will hold it at no charge. If you do not request a hold, we cannot be responsible for damage from freezing or excessive heat and cannot honor claims arising from it.
If you direct us to ship to an address other than your own, or to a recipient other than yourself, you remain responsible under this agreement for receipt, inspection, and installation at that address.
3. Damage claims
If plants arrive in a condition that will prevent them from establishing, you may file a claim for replacement of the affected units. To file a claim, all of the following are required:
- Email info@kurapia.com within 24 hours of delivery as recorded by the carrier;
- Include clear photographs of the plants as received, taken before planting; and
- Include your order number.
Plants that have already been planted cannot be evaluated for delivery condition. Claims submitted after the 24 hour period, or without photographs taken before planting, cannot be honored.
Replacement of the affected units is your sole and exclusive remedy. Our total liability for any claim is limited to the purchase price of the affected units, and does not extend to other units in the same order, to shipping or handling charges, or to any labor, site preparation, irrigation, or other costs.
4. Planting and care
Kurapia establishes reliably when planted and watered as directed. Our planting and care instructions are published at kurapia.com/support and kurapia.com/installation, and printed instructions ship with your order. Please read them before planting.
Planting depth matters. Plugs must be set slightly below the soil surface so that the plug liner is not exposed. Plugs left standing above the soil line will dry out and fail.
Plant failure resulting from installation contrary to these instructions, from insufficient irrigation during establishment, or from site conditions outside our published recommendations is not covered by Section 3. Kurapia is recommended for USDA Zones 7b and warmer.
5. Plant patent and trademark
Kurapia cultivars are protected by United States plant patents, including PP27036, PP29010, PP33485, and PP36439. KURAPIA is a registered trademark of Kurapia, Inc.
Plants purchased from us are for planting at the delivery address only. You may not asexually reproduce, propagate, divide, take cuttings from, or otherwise multiply these plants, and you may not sell, offer for sale, or distribute plants so reproduced. Unauthorized propagation is an infringement of our patent rights.
6. Before disputing a charge
If you have a problem with your order, please contact us first at info@kurapia.com or 626-658-0400. We respond to every message. Contacting us before initiating a chargeback allows us to resolve most issues directly, and card network rules ask cardholders to attempt resolution with the merchant first.
7. General
This agreement is the entire agreement between us regarding your order. It is governed by the laws of the State of California, without regard to conflict of laws principles. The exclusive venue for any dispute is the state and federal courts located in Los Angeles County, California.
